Terms of Service

These Terms govern your use of the Preview Coffee Co. platform (the “Service”) and any associated storefronts, applications, or APIs. By creating an account, accepting an invitation, or otherwise using the Service you agree to these Terms. If you don't agree, don't use the Service.

1. Accounts and eligibility

You must be at least 18 years old and able to form a binding contract. You're responsible for keeping your credentials secure and for all activity on your account. Notify us immediately if you suspect unauthorized access.

2. Plan, fees, and billing

Your subscription plan and fees are shown when you sign up and on your billing settings page. Fees are billed in advance and non-refundable except as required by law. Usage-based overages (AI minutes, design changes, email volume, transaction fees, etc.) are metered and added to your next invoice. Failure to pay may result in suspension of authoring features while keeping your existing storefront available.

3. Payment processing

Card payments accepted through your storefront are processed by Stripe, Inc. via Stripe Connect Express. By onboarding payments you agree to the Stripe Connected Account Agreement and the Stripe Services Agreement. We may collect a platform fee on each transaction in addition to Stripe's processing fees, disclosed in your billing settings.

4. Your content and customer data

You retain ownership of all content you upload (products, copy, images, brand assets) and of personal data your storefront collects about its shoppers (collectively, “Your Data”). You grant us a worldwide, non-exclusive license to host, transmit, transform, and display Your Data solely to provide the Service. Our processing of personal data within Your Data is governed by the Data Processing Agreement.

5. Acceptable use

You will not use the Service to sell prohibited or restricted goods, violate laws, infringe intellectual property, engage in fraud, send unsolicited messages, harvest personal data, scan or attack our infrastructure, or otherwise abuse the platform. See our Acceptable Use Policy for the full list.

6. Service availability and changes

We aim to keep the Service highly available but don't guarantee uninterrupted access. We may add, modify, or remove features at any time. Material changes to paid features will be announced with reasonable notice and your subscription may be cancelled for a prorated refund of the unused term if you don't agree.

7. Termination

You may cancel at any time from your billing settings. We may suspend or terminate your account for material breach of these Terms or the AUP, for non-payment, or as required by law or regulators. On termination you may export Your Data for 30 days after which it may be permanently deleted.

8. Disclaimers

The Service is provided “as is”. To the maximum extent permitted by law we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated content (copy, images, suggestions) is produced by third-party models and is your responsibility to review before publishing.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising from or related to the Service is limited to the greater of (a) the fees you paid to us in the twelve (12) months preceding the event giving rise to liability, or (b) $100 USD. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

10. Indemnification

You will defend, indemnify, and hold us harmless from claims arising out of Your Data, your products or storefront, your violation of these Terms or applicable law, or your infringement of third-party rights.

11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. The federal and state courts located in Wilmington, Delaware have exclusive jurisdiction. Either party may seek injunctive relief in any competent court to protect intellectual property.

12. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version with a new effective date and, for material changes, give you at least 14 days' notice via email or in-product banner. Continued use after the effective date constitutes acceptance.
